Bally’s Kansas City Casino Fight Ended in Fatal Shooting, Murder Charge Filed

A Memorial Day brawl in the parking lot of Bally’s Kansas City Casino that culminated in a fatal shooting has led to murder charges.

Authorities in Jackson County, Mo., said they have charged Grant Lubin, 26, of Overland Park, Kansas, with second-degree murder and armed criminal action in connection with the shooting death of 45-year-old Richard Miller.

According to court filings, Kansas City police responded to a reported shooting inside the garage around 11:45 p.m. on May 25. There they found Miller unresponsive and bleeding from a bullet wound. Officers attempted to help and called emergency medical services. Miller was taken to a local hospital where he was later pronounced dead.

Captured on Security Video

The moments leading up to the shooting were captured by the casino’s security cameras, court documents said. The footage showed Miller, another man, and a woman becoming involved in a confrontation with two men and a woman as Miller’s group left the casino.

According to police, a verbal exchange between the groups escalated when one of the men ran to a vehicle and returned with a handgun tucked into the front of his waistband.

Miller was then pushed and punched before retaliating by striking one of the men and kicking him in the face while he was on the ground. Although Miller briefly got into a vehicle, he returned when the two women began fighting. Court documents state that Miller ran toward the women, shoved them into a wall, and punched one of them.

Police said the armed man was then seen pointing the handgun at Miller and another man before firing a shot at the ground near the man’s feet. After allegedly punching one of the women several more times, Miller struck one of the men, knocking him unconscious.

The armed man then fired in Miller’s direction. According to police, Miller was struck by the gunfire as he turned and attempted to retreat to his car. The group then fled the scene in two vehicles.

911 Call 

An hour after the shooting, a man dialed 911 to report that his girlfriend had been assaulted and needed hospital treatment, adding that he had fired a couple of warning shots in the direction of the assailant. The caller said he then shot the man when he charged at him.

A Jackson County Court judge imposed a $100,000 cash bond on Lubin. The defendant is due in court on June 10 for a bond review and for a preliminary hearing on July 1.
