The 22nd Amendment says only that “no person shall be elected to the office of the president more than twice.” That means the former casino billionaire could theoretically orchestrate a scheme where he runs as vice president and then his running mate resigns to allow him back in the White House.

The Trump Store, the official retail website of The Trump Organization, recently debuted red-colored apparel and merchandise with “Trump 2028” emblazoned on the products. The Trump 2028 items currently for sale include a T-shirt, hat, and koozies. The Trump 2028 shirts include the message, “Rewrite the rules.”

The Trump 2028 hat is $50, the T-shirt is $36, and two koozies are $18.

In late March, Trump said he wasn’t joking about mulling a third term. For that to happen, Congress would need to pass an amendment to Amendment 22 with a two-thirds majority in each chamber. Three-fourths of the state legislatures would then need to ratify the amendment to alter the United States Constitution.

2028 Odds

On Kalshi, the prediction market exchange regulated by the US Commodity Futures Trading Commission (CFTC), bettors give Trump a 14% chance of being allowed to run for the presidency again through a 22nd Amendment modification or the Supreme Court reinterpreting the 22nd Amendment to permit an individual to be elected more than twice.

The contract has fielded about $84K in bets. In early April, those odds were higher at 20%. As for who will be the Republican vice presidential nominee in 2028, Kalshi’s odds suggest Trump is the favorite at 9%.

Current VP JD Vance is the betting front-runner to be the GOP’s presidential nominee at 43%. Over $1.5 million has been bet on the 2028 Republican presidential nominee market. After Vance, former congresswoman and current National Intelligence Director Tulsi Gabbard is at 11%, and Trump is third at 10%.

There’s also speculation that the 2028 Trump gear could be to promote a possible presidential run from one of the president’s children, namely Donald Trump Jr. Kalshi bettors give Trump Jr. a 6% chance of being the GOP’s presidential nominee.

In the UK, where betting on politics is allowed, William Hill has Vance favored at 9/4. Trump is next at 5/1, and Pennsylvania’s Democratic Gov. Josh Shapiro is third at 10/1. California Democratic Gov. Gavin Newsom is fourth at 12/1, and former Transportation Secretary Pete Buttigieg and Congresswoman Alexandria Ocasio-Cortez (D-New York) round out the top five at 14/1.

On X, Eric Trump reshared a post by a conservative commentator that read, “Everyone is losing their minds over the Trump 2028 hat. It’s obviously master trolling. No, President Trump will not run again. Stop crying.”

22nd Amendment Legislation 

In January, US Rep. Andrew Ogles (R-Tennessee) filed House Joint Resolution 29, a proposal to amend the US Constitution “to provide that no person shall be elected to the office of the president more than three times.”

There has been no action on HJR29. It remains in the House Judiciary Committee, the same committee it was directed after its January introduction.
