Man Charged in Oklahoma Casino Kidnapping, Rape Has Homeland Security Immigration Detainer

One of the two men charged in the alleged kidnapping and rape of a woman at a tribal casino in Oklahoma is subject to an immigration detainer from the United States Department of Homeland Security.

During the early morning hours of Sunday, Aug. 17, Arkansas City Police officers were dispatched to the 1600 block S. 6th Street in Arkansas City, Kan, for a reported kidnapping. A caller reported seeing a gray sports utility vehicle that matched reports of a vehicle suspected to be involved in a kidnapping that occurred earlier at the 7 Clans First Council Casino & Resort, about five miles south in Oklahoma.
Law enforcement located the SUV in question shortly before 1:30 am local time in the 400 block of S. 8th St. Police discovered two men, Luis Miguel Dominguez, 35, and Jose Fernando-Lux Morales, 24, both of Arkansas City, inside the vehicle. A female, who told police she had been taken against her will from the tribal casino and had been sexually assaulted, was also found in the car.
The victim was transported to a local hospital for medical care. Morales and Dominguez were booked on numerous charges, including aggravated kidnapping. Dominguez was also charged with rape and aggravated criminal sodomy.
Dominguez Booked
The Cowley County Sheriff Department inmate roster shows Dominguez and Morales remaining in the county prison. Dominguez is facing three felony charges and remains in custody on a $1 million bond. Morales remains behind bars on a $500K bond.
Arkansas City law enforcement says Dominguez is also subject to an immigration detainer from DHS’ Immigration and Customs Enforcement (ICE). Such a detainer requests local law enforcement agencies to hold an individual for an additional 48 hours after their would-be release to allow ICE to potentially take custody of the individual for deportation proceedings.
The female victim told police that she was sexually assaulted by both Dominguez and Morales outside the tribal casino and “while traveling through Arkansas City.”
Dominguez has a lengthy rap sheet in Kansas, including failure to pay child support, failing to appear in court, operating a vehicle without a valid driver’s license, and domestic battery.
It’s unclear why Morales has only been charged with aggravated kidnapping and not rape and aggravated criminal sodomy, as has Dominguez. The Arkansas City Police Department says it continues to investigate the case.
A person found guilty of rape in Kansas faces up to life in prison and fines of up to $500K. The most serious punishments are reserved for those whose victims are underage.
