Couple Sues Resorts World Las Vegas Claiming Black Mold in Room

A couple from Georgia is suing Resorts World Las Vegas for negligence, claiming their hotel room included an amenity they didn’t request: toxic black mold.

Mark and Leilani Nickerson filed suit on June 2 in Clark County District Court, claiming that their January 23 stay in a hotel room at The Conrad made them sick.

Both experienced headaches, flu-like symptoms and irritation, and Mark developed a full-body rash he sought treatment for at an urgent care facility. All are symptoms consistent with mold exposure, though rashes are less commonly reported.

“Plaintiffs, as a result of being exposed to water intrusion, mold and toxins, sustained injuries to their body and shock and injury to their nervous system and person, all of which caused and will continue to cause them physical pain/suffering and emotional pain/suffering,” the lawsuit states.

The Nickersons claim they reported the incident to the hotel staff, who moved them to another room. As they walked by the old room, they saw the door was open and looked inside.

They saw the wall was cut open and the carpet was pulled back, and they observed black mold all over the place,” according to their complaint.

When they asked a maintenance person working on the room, they claim, he confirmed it was mold from water intrusion.

“It happens a lot due to the way the showers were constructed/designed,” the suit claims the Nickersons were told.

When the couple asked Resorts World to comp their hotel room, according to the suit, the property denied their request, instead offering to waive “minor fees” if they signed a waiver of all claims against the property.

The Nickersons claim they denied that request.

Their lawsuit seeks more than $15K in general and special damages, $15K in punitive damages, and remuneration for their past and future medical expenses, economic losses, and attorney fees.

Resorts World didn’t respond to Casino.org‘s request for a comment.
