Hard Rock International, the hospitality and gaming conglomerate owned by the Seminole Tribe of Florida, holds a monopoly on online sports betting in the Sunshine State. The exclusivity stems from Gov. Ron DeSantis (R) in 2021 agreeing to amend the Seminoles’ Class III gaming compact with the state to include online sports gambling privileges.

The compact amendment caused legal pushback in a case that reached the United States Supreme Court. The challenge alleging that the tribe’s hub and spoke model violated the Indian Gaming Regulatory Act (IGRA) ultimately went the tribe’s way, with federal and state courts ruling that online sports betting remains tribal gaming, so long as the online sportsbook facilitating the internet wagers remains on Seminole land.

This week, the only online sportsbook in Florida debuted a new betting product.

The Hard Rock Bet online sportsbook platform now includes “Games,” slot-like interactive offerings that the operator says are based on past motor races.

Games powered by Past Motor Races is a form of sports betting … where a player wagers on the outcomes of real past motor races,” the Hard Rock Bet platform details. The sportsbook says the innovative games are “authorized by the 2021 Compact with the State of Florida.”

The games seemingly align with historical horse racing (HHR) machines, which are slot-like gaming terminals that base their outcomes on previously run horse races. HHR machines allow players to select an auto bet option that picks the horse that had the best odds of winning during the race and simulates the race outcome through spinning reels, animations, and sounds. HHR games are legal in several states, including Alabama, Arkansas, Kansas, Kentucky, New Hampshire, Virginia, and Wyoming.

“The outcomes of those wagers are shown to the player using entertaining video depictions,” Hard Rock says of its motor racing Games. “For each wager, a player selects the finishing order of the drivers in each of the three past motor races. The calculation of the player payout (if any) for each eager is determined by both the player’s successful selections of the finishing orders of the drivers in each of the three races and the probabilities of the drivers that were each selected to finish in a particular finishing order based on the statistics of such drivers as presented to the player.”

Are ‘Games’ iGaming?

DeSantis’ 2021 compact with the Seminoles authorized the tribe to conduct online sports betting. iGaming, or online casino gambling, was not included.

iGaming is legal in only seven states, including Connecticut, Delaware, Michigan, New Jersey, Pennsylvania, Rhode Island, and West Virginia. HHR terminals are typically considered an electronic gambling product that allows racetracks and off-track betting parlors to offer slot-like games.

The Hard Rock Bet sportsbook in Florida acknowledges that “online casino games are not legal in the state of Florida.”

“If you’re interested in casino games, you’ll need to venture out in person to one of the state’s casinos,” the online sportsbook states.
